Protect Innovation & Access in Aesthetics: Oppose Texas House Bill 3749

House Bill 3749 Threatens the Future of Aesthetic Medicine in Texas – Here's Why You Should Care

The Texas legislature is once again targeting the medical aesthetics industry—this time with House Bill 3749 (HB 3749), also known as “Jenifer’s Law.”

While its name might suggest a bill written with safety in mind, its true effect would be devastating for medical spas, mid-level providers, and—most importantly—Texans who rely on accessible, high-quality aesthetic care.

At MNML Aesthetics, based in Dallas, we’ve built our entire philosophy on simplicity, innovation, and medically guided results. But HB 3749 threatens to unravel everything we’ve worked for—and the ripple effects across the state would be massive.


🧾 What Is HB 3749?

Introduced by Representative Angelia Orr in March 2025, HB 3749 proposes sweeping changes that would redefine how med spas operate in Texas. It includes:

🔹 Mandatory On-Site Medical Directors

Every medical spa would be legally required to have a licensed physician with cosmetic training act as their medical director.

🔹 Strict Delegation Requirements

Even when treatments are delegated to Nurse Practitioners (NPs) or Physician Assistants (PAs), the physician must:

  • Conduct the initial consultation in person

  • Write a specific treatment plan before anything begins

  • Be available to immediately arrive onsite if needed

If the physician isn’t physically present, the spa must publicly post a notice stating this—and only providers trained in basic life support can proceed.

🔹 Restricted Use of Nonphysician Providers

Even highly trained NPs and PAs would be limited:

  • They could only perform treatments under the direct delegation of a physician

  • The physician would need to obtain explicit patient consent for every delegated procedure

  • The law doesn’t clearly define what qualifies as “training,” leaving the door open for future restrictions

🔹 Vendor Training No Longer Accepted

Training from product/device manufacturers (like injectables or laser platforms) would no longer qualify. Providers must undergo separate, undefined training, adding another layer of ambiguity—and cost.


🚨 How This Would Hurt MNML Aesthetics and Others Like Us

At MNML, we’ve created a modern treatment model that’s medically supervised, results-oriented, and accessible to clients of all backgrounds. But this bill would:

  • Dramatically increase operating costs by forcing constant physician presence

  • Create barriers to access for clients in underserved or rural areas

  • Undermine trained and licensed NPs and PAs who are already qualified to deliver these services safely

  • Slow innovation, adding red tape to every step of the process—from consultations to follow-ups

Let’s be clear: We support regulation that improves safety. But HB 3749 is not about safety—it’s about overregulation, micromanagement, and unnecessary hurdles that punish responsible providers and limit patient freedom.


 

🧠 The Big Picture: What’s at Stake

  • Choice: Texans should be able to choose who provides their care—especially when those providers are trained, licensed, and experienced.

  • Access: Many smaller med spas may be forced to shut their doors, especially in areas where staffing a full-time physician isn’t financially feasible.

  • Jobs: Mid-level professionals will face reduced opportunities—hurting an industry that empowers nurses, PAs, and female entrepreneurs.

  • Affordability: Increased operating costs mean higher prices for patients who simply want safe, effective care.

This is more than a bill. It’s a direct threat to the modern, thriving field of aesthetic medicine in Texas.
